TERMS and CONDITIONS OF SALE

Prices are subject to alteration or cancellation without previous notice. The date of delivery, not the date of order, will determine the price charged.   Changes in legislation or Government Regulations relating to taxation or duties, which affect our prices, will apply immediately on all undelivered orders or contracts.   Prices listed are for palletised product, delivered home to customers’ premises where forklift unloading is available.

PAYMENT

Accounts are due for payment on 20th day of month following month of delivery.

Accounts that are not paid by the last working day of the month following month of delivery are deemed to be over-due and will be subject to 1% per month interest charge from that date or a price surcharge of €2 per tonne per month on all tonnes not paid for from that day.

The Company reserves the right to collect over-due accounts.

RESERVATION OF TITLE.

• The property in the goods shall remain in the Seller until the Seller has received
  payment in full for all sums due and owing on any account by the Buyer.
• If the Buyer shall sell or otherwise dispose of the goods before payment in full as
  aforesaid has been made to the Seller, the Buyer shall in such case hold all monies
  received by him from such sale or disposal in trust for the Seller and shall on request furnish the Seller with the names and addresses of the persons to whom such disposals have been made together with all necessary particulars to enable the Seller to recover any outstanding sums due from such persons.
• So long as the property in the goods shall remain in the Seller, the Buyer shall hold the goods as bailee for the Seller and store the goods so as to clearly show them to be the property of the Seller, and the Seller shall have the right, without prejudice to the obligations of the Buyer to purchase the goods, to retake possession of the goods (and for that purpose to go upon any premises occupied by the Buyer).
• Nothing in this clause shall confer any right upon the Buyer to return the goods.
  The Seller may maintain an action for the price notwithstanding that property in the goods shall not have vested in the Buyer.

PACKING

Unless otherwise stated, all products will be packed in 50 Kilogramme (Kg.) polythene bags.

QUALITY & SHORTAGES

All our products are dispatched in good order and condition. Complaints relating to quality or shortages should be notified to us within seven days, otherwise, no responsibility can be accepted. No complaint, including farm level, will be considered unless all product is available for inspection. No credit will be allowed for material returned damaged or broken due to circumstances outside our control.

FORCE MAJEURE

All orders are accepted in good faith and while every effort will be made to execute such orders, no responsibility can be accepted for failure to do so through circumstances outside our control, such as shortage or excessive costs of raw materials or services, strikes, lockouts, or other disputes affecting our business.

GUARANTEE

The analysis of our fertilizers marked “E.C. Fertilizers” are guaranteed in accordance with the European Communities Act 1972 giving effect to Council Directive 76/116/E.E.C.
The remainder of our products are guaranteed in accordance with the Fertilizer, Feed Stuffs & Mineral Mixtures Act 1955.
